Trading Terms & Conditions

1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", "your") and R A & K Haulage Limited ("Company", "we", "us", "our"), a company registered in England and Wales.

By engaging our services or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Services Provided

R A & K Haulage Limited provides the following services:

  • Road freight haulage and logistics services throughout the United Kingdom
  • Container transport and port terminal services
  • Pallet distribution and groupage services
  • Warehousing and storage solutions
  • Shipping container sales (subject to 4-week lead time)

3. Quotations and Contract Formation

3.1 Quotations

All quotations are valid for 30 days from the date of issue unless otherwise stated. Quotations are subject to availability and may be withdrawn at any time before acceptance.

3.2 Contract Acceptance

A binding contract is formed when: (a) we accept your order in writing, (b) we commence performance of services, or (c) you accept our quotation.

3.3 Pricing

All prices are quoted in British Pounds (GBP) and are exclusive of VAT unless otherwise stated. We reserve the right to adjust prices due to changes in fuel costs, tolls, or regulatory requirements.

4. Customer Obligations

The Customer must:

  • Provide accurate information regarding goods to be transported, including weight, dimensions, and contents
  • Ensure goods are properly packed and labeled in accordance with relevant regulations
  • Obtain and provide all necessary documentation, licenses, and permits
  • Declare any hazardous, dangerous, or restricted goods prior to booking
  • Provide safe loading and unloading facilities with appropriate access
  • Be available at collection and delivery addresses during agreed time windows

5. Liability and Insurance

5.1 Standard Liability

Our liability for loss or damage to goods is limited to £1,300 per tonne gross weight of the goods lost or damaged, in accordance with the RHA Conditions of Carriage 2009.

5.2 Insurance Cover

We maintain Goods in Transit insurance and Public Liability insurance. Extended cover may be available upon request for an additional premium.

5.3 Claims Procedure

Claims for loss or damage must be notified in writing within 7 days of delivery (or the date delivery should have occurred). Claims must be accompanied by supporting documentation including proof of value.

Exclusions: We are not liable for loss, damage, or delay caused by circumstances beyond our reasonable control, including but not limited to adverse weather, strikes, road closures, or acts of God.

6. Payment Terms

  • Payment Due: Unless otherwise agreed in writing, payment is due within 30 days of invoice date
  • Late Payment: Late payment charges of 8% per annum above the Bank of England base rate will apply to overdue accounts, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998
  • Credit Accounts: Credit accounts are subject to credit checks and approval. We reserve the right to require payment in advance or on delivery
  • Retention of Goods: We reserve the right to retain goods until payment is received in full

7. Cancellation, Multi-Unit Orders & Special Work Policy

Important information regarding order cancellations and special work requests

7.1 Cancellation Fees

7.1.1 Any cancellation of an order by the Customer shall incur a cancellation fee equal to 50% of the total order value.

7.1.2 The cancellation fee is applied to cover, but is not limited to:

  • Administrative costs
  • Sales and processing time
  • Accounting and transaction costs
  • Haulage planning and logistics scheduling
  • Operational and allocation costs

7.1.3 The cancellation fee shall be payable regardless of the stage of order processing.

7.2 Multi-Unit Orders

7.2.1 Where multiple units are purchased under a single order, such units may be grouped, allocated, scheduled, or processed collectively.

7.2.2 Cancellation of one unit within a grouped or multi-unit order may result in the entire order being deemed void, at the Company's discretion, where separation is not commercially viable.

7.2.3 In such circumstances, the 50% cancellation fee shall apply to the total order value.

7.3 Special Work & Unit Reservation

7.3.1 Once a Customer requests any modification, customisation, fabrication work, or special preparation on a unit, that unit shall be immediately removed from the open market and treated as a reserved unit for that Customer.

7.3.2 From the point of reservation, the unit is considered committed stock and unavailable for resale during the reservation period.

7.3.3 Any cancellation made after special work has been requested shall automatically incur the 50% cancellation fee.

7.3.4 The cancellation fee applies whether or not payment has yet been made.

Important Notice

By requesting any special work, modification, or customisation, you acknowledge that the unit becomes reserved exclusively for you and that the cancellation policy will apply immediately upon such request. Please ensure you are committed to the order before requesting any special work.

7. Cancellation and Amendments

7.1 Customer Cancellation

Cancellations must be made in writing. Cancellation charges may apply: More than 24 hours notice - No charge; Less than 24 hours notice - 50% of quoted price; Less than 2 hours or no-show - 100% of quoted price.

7.2 Service Amendments

We reserve the right to amend delivery schedules or sub-contract services to third parties where necessary to fulfill our obligations.

7.3 Container Sales

All shipping container orders are subject to a 4-week lead time. Cancellations of container orders may incur a restocking fee.

8. Prohibited and Restricted Goods

We do not accept the following goods for transport unless specifically agreed in writing and properly declared:

  • Illegal substances or items prohibited by law
  • Hazardous materials without proper ADR certification and documentation
  • Live animals (except with specialist arrangements)
  • Cash, bullion, precious stones, or irreplaceable items
  • Perishable goods without refrigerated transport arrangements
  • Goods requiring special licenses without proper documentation

Warning: Customers who fail to declare prohibited or restricted goods may be held liable for any costs, fines, or penalties incurred, and we reserve the right to refuse carriage or dispose of such goods.

9. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: severe weather conditions, strikes, industrial action, road closures, accidents, vehicle breakdowns, acts of God, pandemic, terrorism, war, or government restrictions.

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please refer to our Privacy Policy (above on this page) for full details of how we collect, use, and protect your personal information.

11. Dispute Resolution

11.1 Complaints Procedure

If you have a complaint about our services, please contact us in writing within 7 days. We will acknowledge your complaint within 5 working days and investigate thoroughly.

11.2 Alternative Dispute Resolution

In the event of a dispute, we encourage resolution through negotiation. If necessary, disputes may be referred to mediation before pursuing legal action.

11.3 Jurisdiction

These Terms are governed by the laws of England and Wales. Any legal proceedings must be brought in the courts of England and Wales.

12. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between the parties and supersede all previous agreements or representations
  • Severability: If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force
  • Waiver: Failure to enforce any right or provision does not constitute a waiver of that right or provision
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent
  • Third Party Rights: These Terms are not intended to confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999
